A “trademark” means any sign capable of being represented graphically which is capable of distinguishing goods or services of one undertaking from those of other undertakings. A trademark may, in particular, consist of words (including personal names), a figurative element, letters, numerals or the shape of goods or their packaging.
GTG has a strong trademark practice encompassing a wide array of speciality areas. In addition to assisting clients in searching and clearing trademarks and in the registration, licensing and assignment of trademarks, we also work closely with our clients to enforce their trademark rights and to develop understandable trademark use guidelines for proper internal use.
Trade Mark Protection
The protection granted by a trademark is territorial in nature. As a result, GTG can assist clients in registering either for protection on a local basis or else throughout the European Union by means of a Community Trade Mark. The proprietor of a registered trademark has exclusive rights in the trademark. Such rights are infringed by such use of the trademark in Malta or Europe as the case may be without the consent of the proprietor. |
